The following sets forth the Privacy Policy (“Privacy Policy”) of UVNV, Inc., including its affiliates, assigns, and agents (“UVNV,” “Ultra Mobile”, “we,” “us,” or “our”), and is incorporated into and made a part of the Home Internet Service Agreement (the “Agreement”), as well as the corresponding Terms & Conditions (“T&Cs”). The Agreement, including this Privacy Policy and the T&Cs, relate to a fixed wireless internet service we are providing to you under certain terms and conditions, which service is referred to throughout as the “Service.” As described below, this Privacy Policy extends to your use of the Service or any other service provided by UVNV, in addition to certain other activities.

Accordingly, UVNV provides this Privacy Policy so you understand how UVNV collects, uses and, in certain circumstances, discloses the information that you provide and/or that is automatically provided to UVNV as a result of your visiting and using the UVNV Fixed Wireless web site or any other website or portal owned and operated by UVNV (collectively, the “Sites”), and/or purchasing or using the Service or any other service provided by UVNV (collectively, the “Services”). This Privacy Policy also explains your options regarding the collection, use and disclosure of your personal information. UVNV is not responsible for the content or privacy practices on any third-party web site that may be linked to or from the Sites. If you do not agree with the policies outlined in this Privacy Policy, do not visit our Sites our use our Service. 2. Collection and Use of Personal Information

Personal information is information that identifies or is associated with a specific individual, such as a name, address, email address, or telephone number. UVNV collects personal information about its Customers and certain other individuals, including without limitation any individuals who visit the Sites. The ways in which we collect personal information about you include, but are not limited to, the following:

Registration and Ordering. Before using certain parts of the Sites or purchasing Services, you must complete an online registration form or provide certain information to UVNV’s representatives. During registration (whether via the Sites or otherwise), you will be prompted to provide to UVNV certain personal information, which may include, but is not limited to, your name, billing address(es), phone number, port-in phone number, email address, and credit card number. This personal information is used for billing purposes, fulfilling your orders, communicating with you about your order or the services, and for marketing purposes.
User Submissions. Certain locations in the Sites may permit you to enter your email address and other contact information to receive further information about UVNV or for other purposes. Your submissions for these purposes are completely voluntary, so you have a choice whether to participate and disclose information to UVNV. Should you choose to submit information in response to these requests, UVNV may collect and use your name, email address, geographic location and other information submitted on the Sites to market UVNV’s (including Affiliates’) products and services.
Automatically Generated and Collected Information. In addition to information that you volunteer as described above, the Sites may utilize technologies to collect information and track your user experience. UVNV will use this information to improve the Sites and user experience. In addition, the Sites automatically recognizes the Internet URL from which you access the Sites and may also log your Internet protocol (“IP”) address (which may indicate the location of your computer on the Internet), Internet service provider, and date/time stamp for system administration, order verification, marketing, and system troubleshooting purposes. In addition, all wireless communication systems know when your Device is turned on and approximately where the device is physically located.
Information from Third Parties. We may obtain information about you and combine it with your account information. For example, we may receive information from the retailer from whom you purchased an Ultra Mobile product prior to your commencing service with us. In addition, we use a third-party service provider to serve ads and/or collect data on our behalf across the Internet and sometimes on this Web site. Some of these service providers may collect information about your visits to our Web site, and your interaction with our products and services to tailor marketing messages on this Web site and other sites or to trigger real time interaction, customize this Web site or enhance your profile. Some of these service providers may be able to collect personal information that you share with this site via a web form automatically and prior to your pressing a submit button; and they may be able to use information from your visits to this site to send marketing messages to you in a way that may personally identify you. This information is collected through the use of a cookie, a javascript tag and/or pixel, which is industry standard technology used by most major web sites. The information collected by these service providers may include your device’s IP address, user agent, email addresses (where hashed or otherwise rendered pseudonymous) and other user and device level pseudonymous information. The Service provides only broadband Internet access and is neither required to provide, nor provides, 911 calling services. We shall not be responsible or liable for any voice application or service, including without limitation such application’s or service’s provision of 911 calling, unless such application or service is provided by Ultra Mobile and Ultra Mobile agrees to such responsibility and liability in writing.
Generally, UVNV collects the above information for the following purposes: (i) to improve your experience on the Sites; (ii) to improve the products and services that UVNV sells; (iii) to communicate with you regarding the Sites; (iv) to market and sell products and services to you and send you information about special offers; (v) to contact you about products or services you have purchased from UVNV; (vi) to respond to your inquiries; (vii) to manage and develop our business and operations, administer accounts, and collect and process payments; and (viii) if you authorize text messaging, we will use your mobile number to communicate with you about your account and to send marketing text messages to you. If you decide that you no longer wish to receive emails or text messages from us that you had authorized, you may opt-out of receiving emails and text messages by managing your account preferences on the Web site or by any other reasonable opt-out method available to you. Please note that Ultra Mobile may have to communicate with you about product or service orders that you choose to place. You cannot opt-out of receiving product or service-related emails.

UVNV will not sell, rent, trade, license or otherwise disclose your specific personal information or financial information to third parties, except that: (1) UVNV uses third parties to perform specific functions on its behalf and it must disclose information to help those parties perform their services (for example, UVNV would disclose your name, address and phone number to a commercial carrier such as Federal Express or UPS in order to deliver a physical product that you order); (2) UVNV must disclose your name and credit card number and information to financial services and credit card processing companies in order to process your orders; (3) UVNV may be required to disclose such information in response to a legal process, order or investigation (for example, a subpoena or court order); (4) UVNV may disclose personal information where disclosure is necessary to protect its legal rights or to protect itself or others (for example, in order to reduce the risk of fraud or illegal activities); (5) UVNV may share such information amongst the Affiliates and third parties for the purpose of improving our (or the Affiliates’) ability to market products and services to you; (6) UVNV may provide identity verification services to third parties and your personal information may be included in the data transferred to third parties in connection with those services; and (7) UVNV may acquire, merge with or be acquired by another company or it might sell some or all of its assets, and, in such a case, your personal information may be included in the transferred business assets. Also, in the event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, we may not be able to control how your personal information is treated, transferred, or used and your personal information may be included in the transferred assets. UVNV may sell, rent, trade, license, use and disclose all non- personal information and aggregate information, so long as such information does not personally identify you or any user, to any third party for any purpose, including, but not limited to, research and analytical purposes.

3. Cookies

“Cookies” are pieces of information that may be placed on your computer by a Sites for the purpose of facilitating and enhancing your communications and interaction with that Sites. Cookies may possibly be used for such things as: (1) to customize your visitation and shopping experience; (2) to deliver content consistent with your stated interests; (3) to provide you with custom-tailored content; or (4) to save your password in password-protected areas. 4. Children’s Online Privacy Protection Act

Our Sites are not intended for children under 13 years of age. No one under age 13 may provide any information, personal or otherwise, to or on any of our Sites. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Sites or on or through any of its features, make any purchases, use any of the interactive features, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. 5. Advertisements and Links

The Sites may display advertisements and links for third-party websites, products and services. Information you provide directly to third parties and information collected from you by third parties in connection with your use of their websites, products or services will be subject to such third parties’ privacy policies and not this Privacy Policy.

6. YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798 entitles California customers to request information concerning a business’s sharing of personal information to any third parties for the third parties’ direct marketing purposes. Ultra Mobile will not knowingly share your personal information with non-affiliated third parties for their direct marketing uses without your opt-in consent. California customers who wish to request further information about our compliance with this law or have questions or concerns about our privacy practices and policies may contact us as specified in the “Contact Us” section below. Do Not Track (DNT) Disclosure: This Site does not currently respond to “Do Not Track” signals of web browsers. However, should the industry establish uniform technological standards for recognizing and implementing “Do Not Track” signals, Ultra Mobile would be open to following such industry standards.

7. California Subscriber Rights

As of January 1, 2021 if you are a California resident, as defined in the California Code of Regulations, you have rights under the California Consumer Privacy Act of 2018 (the “CCPA”). A description of your rights and disclosures about how we process your personal information are below.

California residents will also have the right to not be discriminated against if they exercise their rights under the CCPA. Before we honor your rights to request information or delete information, we must verify your or your authorized agent’s identity. In certain cases, we may require you to provide additional information in order to verify your request.

UVNV does not sell your personal information, but we may disclose your personal information to service providers who support our operations.

8. revisions

From time to time, we may revise the Privacy Policy. Your use of the Sites or Services following the posting of any revised Privacy Policy shall be deemed acceptance of the revised policy, so we recommend that you check the Privacy Policy periodically. If you disagree with the terms of the Privacy Policy at any time, your sole remedy is to terminate your use of the Sites and Services. Continued use of the Sites or Services constitutes your agreement to any Privacy Policy as in effect.
